Indiana courts see changes with new e-filing system

Electronic filing is transforming the way Indiana's judicial system works.
Fifty-five of the state's 92 counties have adopted mandatory electronic filing for most new criminal and civil lawsuits over the past 15 months, The (Northwest Indiana) Times reported. The state's appellate division has also adopted the electronic system.
The Supreme Court's Office of Court Technology says more than 2.1 million documents have been electronically filed in the state since July 1, 2016.
E-filing makes judges and lawyers more efficient and improves court services for Indiana residents, said Justice Steven David. Non-confidential court documents are also available online.
E-filing has been adopted quickly through the state because may counties are using the same case management system called Odyssey, said Justice Mark Massa.
The system is paid for by a $20 automated record keeping fee that's attached to every case filed in Indiana court.
"It's the best deal for counties," Massa said. "It carries with it state funding of that technology and that support, and we're getting closer and closer to that complete statewide coverage with each passing year."
The system also allows the judicial branch to generate comprehensive data about crimes, courts, dispositions, children in need of services, protection orders and other information that the legislative and executive branches need when enacting new laws, David said.
"In the old days, you might get data from one court and try to extrapolate, or determine if that court is representative of the rest of the state or not, and that's no longer the case," David said. |

Dispute over rights to Tom Clancy's Jack Ryan goes to court

Tom Clancy's widow wants a court to rule that the author's estate is the exclusive owner of the rights to his famous character Jack Ryan.
News media outlets report that Alexandra Clancy's lawsuit says that the author's estate should be the sole beneficiary of any posthumous books featuring the character who was first introduced in "The Hunt for Red October."
Alexandra Clancy is suing the personal representative of Clancy's estate, J.W. Thompson Webb, for allowing other entities to profit from posthumous book revenues. Clancy's first wife, Wanda King, is a partial owner of those other entities.
The lawsuit says: "Tom Clancy made Jack Ryan; and in a sense, Jack Ryan made Tom Clancy."
The lawsuit was filed in the Circuit Court in Baltimore. Tom Clancy died in 2013.

Supreme Court Justice Sotomayor to speak in Tuscaloosa

U.S. Supreme Court Associate Justice Sonia Sotomayor will speak at the University of Alabama law school next month.
Sotomayor will participate in a discussion with dean Mark Brandon and U.S. District Judge Harold Albritton III on Sept. 12. Brandon says in a statement the school is honored to have her.
Former President Barack Obama appointed Sotomayor to the court in 2009. The New York native served on federal district and circuit courts before that.
Alabama isn’t an Ivy League university, but it has had a lot of success in luring Supreme Court justices to speak at its law school. Eleven justices have spoken in Tuscaloosa since a lecture series began in 1996. |

German court orders sentence enforced in Chile abuse case

A court in western Germany has ruled that a German man must serve the sentence of a Chilean court for his role in the sexual abuse of children at a secretive German colony in Chile.
The dpa news agency reported Monday that the court in the town of Krefeld said Hartmut Hopp must serve in Germany the five-year sentence given to him by a Chilean court in 2011 for 16 counts of aiding in the sexual abuse of children.
The crimes took place at the Colonia Dignidad enclave, where residents were physically and psychologically abused for three decades beginning in 1961 after moving there from Germany.
Hopp fled to Germany before the verdict took legal effect. The 73-year-old denies the charges and his attorney says he will appeal the ruling.

Rhode Island high court vacates conviction in triple slaying

Rhode Island's highest court has overturned the conviction of a 21-year-old man serving two consecutive life sentences for a 2012 triple slaying at a housing complex.
Authorities allege the then-16-year-old Quandell Husband had plotted with three others to rob a marijuana dealer at a Providence apartment. Shemeeka Barros, her boyfriend Michael Martin— who was the primary target — and their friend, Damien Colon, were fatally shot. Husband was convicted of three murder counts in 2014.
The state Supreme Court on Wednesday found that the Superior Court judge abused his discretion by allowing the jury to consider "enormously prejudicial" evidence that shouldn't have been admitted at the trial.
The case has been sent back to Superior Court. The attorney general's office says the state is prepared to move forward and retry the case.
